Disclaimer

§ 1 Scope of application

(1.) The Velosuisse Association (hereinafter referred to as "Association") provides its offers and services to the respective Association member (hereinafter referred to as "Member") exclusively on the basis of this disclaimer. Deviating conditions or general terms and conditions (GTCs) of the Member do not apply. They shall also not apply if the Association has not expressly objected to these external terms and conditions.

(2.) This disclaimer is published exclusively at this point. By becoming a member of the Association, the member has accepted this disclaimer and acknowledges it as a valid contractual condition.

(3.) Amendments to the disclaimer will be published exclusively on this page. If the member does not agree with the changes to the disclaimer, he/she must report this to the above address.

(4.) If a member withdraws from the association, his/her presence in the member area will also be deleted without prior notice and right of objection.

§ 2 General

(1.) The association creates and maintains this homepage itself or through third parties. This service is a component of the association membership. In particular, the service also includes the creation of the member's company presentation in the "Members" section of this homepage and the storage of this information on web servers for publication in the worldwide computer - communication network Internet. In addition, the respective software contract and licence conditions for which the association is responsible apply.

(2.) The association assumes no liability for unforeseeable and foreseeable disruptions in the business operations of the association or a commissioned provider, especially force majeure, technical disruptions or failures of administrators.

§ 3 Presentation contents

(1.) The association creates the internet presentation. However, the association is not responsible for the content of the links, data and information provided by the member in the member area and elsewhere on this homepage. The member expressly assures that the contents provided by him or created according to his information do not violate Swiss law or his home country law, which may differ from this, in particular copyright, data protection and competition law. The association is not obliged to check the content. The Association reserves the right to exclude pages that appear questionable in terms of content from storage on a server and thus not to release them for publication. The member hereby indemnifies the association from claims for compensation by third parties based on inadmissible content on the member's website.

(2.) The association reserves the right to change or correct content (pictures, graphics, fonts, text structures) within the website design in such a way that an optimal presentation is made possible. Changes to the layout, text content and the overall design or structure as well as the use of other pictures or graphics will only be made in consultation with the member.

(3.) The association has created this homepage primarily in German language. French and English translations - if not supplied by the member - are partly done dynamically by a translation service provider and may differ from the German text in content. The association declines any liability for deviating text contents in translations.

§ 8 Applicable law and other

(1.) The association is entitled to use the name of the member and the web presence created by the association for the member as a reference and to advertise with it, unless the member expressly declines this.

(2.) Liability and compensation claims are expressly excluded.

(3.) In order to avoid damages and consequential damages, the association has a permanent duty of control and security. Compensation for consequential damages is excluded.

(4.) The member agrees that within the scope of this disclaimer data may be processed, stored and passed on to third parties.

(5.) The member acknowledges possible copyrights of third parties.

(6.) As the final instance, the Executive Board of the Association shall decide on differences of opinion between the parties. The statutes of Velosuisse and Swiss law apply.

(7.) Deviating conditions of the member have no validity. Unless they are confirmed in writing by the association. Verbal agreements are invalid.
